Privacy policy

1. Controller

RKV Consultants and Engineers, proprietor Sunil-Rajender Vip, Schlüts Kamp 6, 32469 Petershagen, Germany, email: info@rkv-consultants.com.

2. Website access and server logs

When you access the website, the server processes technically necessary connection data: IP address, date and time, requested address without URL parameters, data volume, status code, referrer, and browser and operating-system details. This supports secure and stable delivery, error analysis and abuse prevention on the basis of our legitimate interest under Article 6(1)(f) GDPR. Raw logs are deleted according to the server’s configured rotation rules. If a specific security incident occurs, we retain the records needed until the investigation is complete.

3. Quotation and contact enquiries

We process the contact, address, module, hardware and system details you provide to automatically create a non-binding PDF quotation, send it to your email address, prepare the technical assessment and inform RKV about the enquiry. The sent PDF is stored in a protected quotation archive on our website server. Only the operator can retrieve this archive through a separate read-only SFTP account; no public download is available. The legal basis is Article 6(1)(b) GDPR. Quotations and enquiries that do not result in a contract are deleted after no more than six months. If a contract is concluded, the quotation is transferred to the business records and statutory retention periods for business and tax records apply.

For a short compatibility enquiry, we process only your email address, selected device types, any models you provide and your energy goal to review the details personally and reply by email. We do not create a PDF, calculate travel or store anything in the quotation archive. Your details are sent to our fixed email inbox; you receive an acknowledgement. The legal basis is Article 6(1)(b) GDPR. Enquiries without a contract are deleted after no more than six months.

For an enquiry from a trade partner, we process the company, contact name, business email address, optional phone number, trade and proposed digital integration only to assess your request and respond personally. We send this information to our operator mailbox and send you an acknowledgement. We do not create a PDF quotation or customer account, and we do not send a site address to a routing service. The legal basis is pre-contractual steps under Article 6(1)(b) GDPR or, for business contacts, our legitimate interest in responding to professional project enquiries under Article 6(1)(f) GDPR. If no contract is concluded, we delete enquiries within six months unless statutory retention duties apply.

If you request an on-site appointment, only the start and destination addresses needed for the route are sent server-side to a routing service; your name, email address, telephone number and module selection are not sent. Google Maps Platform, provided by Google LLC, is preferred. If it is not configured or cannot be reached, Nominatim and an OpenStreetMap-based routing service are used. The response contains distance and driving time. The PDF clearly identifies the source, one-way route and the outward and return journey calculated using the rates in the pricing workbook. This routing is required for the quotation you request and is also based on Article 6(1)(b) GDPR. Processing in the USA cannot be ruled out for Google; the open fallback services may process data in the United Kingdom or at the relevant European service location.

For an individual enquiry without priced selections we send your contact details, wishes and optional equipment information to our operator mailbox for a personal reply. You receive an acknowledgement; no automatic PDF quotation or quotation archive entry is created. A requested on-site visit is first arranged personally; no route is calculated at that stage. The same enquiry legal bases and deletion periods described above apply.

Shop orders

For your order we process your name, email address, postal address, selected items and quantities, prices, order reference, and the time and version of the accepted terms. We store these records securely on our website server to process the contract, reconcile payments and comply with statutory retention duties (Article 6(1)(b) and (c) GDPR). Order and payment acknowledgements are emailed to you and our operator mailbox. We do not store your PayPal account credentials. PayPal processing is described separately below. Your browser session storage retains the basket, a random order identifier and personal payment links to resume checkout and prevent duplicate orders. Your name and postal address are not stored there. These session records are removed when the browser session ends.

4. Voluntary sales information and newsletter

Separate consent selected for additional offer information or the RKV Smart Home newsletter is based on Article 6(1)(a) GDPR. Newsletter registration is voluntary, is not preselected and only becomes effective when you click the confirmation link sent by email. We store your email address, name, timestamp, consent-text version and confirmation time as evidence of consent. You can withdraw consent at any time with future effect using the unsubscribe link in any newsletter email or by emailing us. Processing your demo or quotation request does not depend on this voluntary consent. Following withdrawal, your email address and consent data are deleted from the newsletter list.

5. Hosting and email delivery

This website and the delivery of confirmations, demo access, newsletters and enquiries are provided through STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. Acting as a processor, STRATO processes technical connection data and the sender, recipient and message content required for email delivery. Processing takes place in Germany; no transfer to third countries is intended for this operation.

6. Cookies, local storage and audience measurement

We do not use external advertising, analytics or social-media services. For internal audience measurement, we reduce server logs to daily counts by page and broad traffic source. After device-review, quotation or trade-partner enquiries are successfully sent, we also count the request type and a broad source category; it is unverified and does not prove a purchase. This helps us understand use and improve the website. The analysis does not create individual user profiles. A random form identifier stays in the open browser window; a related hash is stored for no more than 24 hours to detect retries. IP addresses, full referrer addresses, campaign names and browser identifiers are not included in the statistics. Daily totals are deleted after no more than 24 months. The legal basis is our legitimate interest in privacy-conscious measurement of website reach and performance under Article 6(1)(f) GDPR. Fonts and images are served by this website. The live demo requested by you uses a secure session cookie and may store necessary display settings in your browser; these operations provide the service you requested (section 25(2)(2) TDDDG).

7. Agreed payments with PayPal

For confirmed orders or separately agreed remote support, we may provide a personal payment link. Before payment, we display the reference, payment stage and amount. When you open a valid personal payment link, the payment page loads the PayPal button after checking the reference and amount. This connects your browser to PayPal, which may process technical connection data. A PayPal order is created only when you click the button. We send PayPal the order reference, amount and currency. PayPal (Europe) S.à r.l. et Cie, S.C.A. processes the payment under its own responsibility; details are in the PayPal privacy statement. On our website server, we keep a separate payment record containing the order reference, payment stage, amount, a hash of the personal link, PayPal order and capture identifiers, status and timestamps, and identifiers of signature-verified events. We do not store PayPal login credentials or full payer details there. Processing serves contract performance (Article 6(1)(b) GDPR), payment reconciliation and statutory accounting and retention duties (Article 6(1)(c) GDPR). Payment records are deleted when no longer needed and after applicable statutory retention periods. Payment does not automatically start the service or authorise any device action.

8. Your rights

Subject to the GDPR, you have rights of access, rectification, erasure, restriction of processing, portability and objection. You may withdraw consent at any time with effect for the future. You may also complain to a data protection supervisory authority.

9. Competent supervisory authority

Data Protection and Freedom of Information Commissioner of North Rhine-Westphalia, Kavalleriestraße 2–4, 40213 Düsseldorf, phone +49 211 38424-0, email: poststelle@ldi.nrw.de, www.ldi.nrw.de.

Online appointment booking

Privacy notice for the appointment calendar

We use Cal.com, a service provided by Cal.com, Inc., 2261 Market Street #4382, San Francisco, CA 94114, USA, for online bookings. The embedded calendar loads automatically when you visit the consultation page; the support page also loads its calendar on access. Your browser connects to Cal.com before you make a booking.

Cal.com’s privacy notice lists IP address, browser and device information, referrer, pages visited and timestamps as technical data. Cal.com says its product uses cookies for login, preferences and security. When you book, Cal.com processes the contact and appointment details you enter, as well as answers to booking questions; booking data is made available to RKV to manage and provide the appointment. Cal.com describes booking data as processing on behalf of the account holder, and its own account, billing and support data as its own processing. The specific roles and terms depend on the booking activity.

The calendar shows available times directly and helps prevent double bookings. Our legitimate interest in arranging appointments without an additional email exchange is the legal basis for displaying it (Article 6(1)(f) GDPR); performing a booked appointment is based on Article 6(1)(b) GDPR. You can contact us by email or through the quotation form instead. Cal.com states that data is processed in the United States and, in some cases, by service providers in other countries. Its privacy notice describes the transfer mechanisms, providers, retention and data-subject rights that apply. Cal.com privacy notice.

For directly booked remote support, Cal.com processes your booking details and payment status and directs you to PayPal for payment. The appointment is confirmed only after successful payment. RKV receives the booking and payment information needed to provide and manage the appointment and meet accounting duties; the separate RKV payment service for individual quotations is not used. The legal basis for booking and payment processing is Article 6(1)(b) GDPR, and for statutory retention Article 6(1)(c) GDPR. PayPal processing is described in the PayPal privacy statement.

Demo access

Privacy notice for the live demo

For the requested demo, we process your name, email address, request time, confirmation status, truncated or hashed security attributes and technically necessary connection data. This verifies the email address provided, supplies personal short-lived demo access, prevents misuse and informs RKV of the request. The information is sent automatically to info@rkv-consultants.com.

The legal basis is Article 6(1)(b) GDPR and our legitimate interest in secure access that cannot be shared publicly under Article 6(1)(f) GDPR. Unconfirmed activation tokens are deleted after 30 minutes, misuse-prevention information after 24 hours, and the demo session no later than the end of the day. The enquiry directory, accessible only to the operator, retains names, email addresses and request and confirmation status for no more than six months; entries without active newsletter consent are then deleted automatically. A confirmed newsletter address is retained until consent is withdrawn.

A confirmation email is sent immediately after submission. Beforehand, the email format and technical reachability of its domain are checked, and known disposable-email domains are rejected. Access to the specified mailbox is only established when the one-time link is clicked. The link can be used once, remains valid for 30 minutes and the demo access it starts ends no later than the end of the day. If the voluntary newsletter option was selected, the same clearly explained click also confirms this consent; without that selection, no newsletter entry is created.

Contractual basis

Terms and conditions

1. Scope and formation of contract

These terms apply to quotations by RKV Consultants and Engineers for RKV Smart Home software, configuration, integration, support and optional hardware. Outside the shop order and direct appointment routes described below, the website remains non-binding; the contract is formed by acceptance of an individual quotation or an explicit order confirmation. Directly bookable 60-minute remote support is an exception: the contract is formed after successful PayPal payment and confirmation of the Cal.com booking. The individual quotation takes precedence if it differs.

2. Services

Scope, supported equipment, hardware, remote or on-site services, dates and prices are set out in the quotation. RKV uses existing local or manufacturer-approved interfaces. Functions of third-party devices, manufacturer cloud services and internet services may change beyond our control.

3. Customer cooperation

The customer supplies accurate equipment details, suitable network and power facilities, required manufacturer access and secure remote access, and ensures that electrical work is performed only by authorised specialists. Credentials must not be transmitted publicly.

4. Prices and payment

Prices on information pages are shown net. The shop shows the net subtotal, statutory VAT and the total payable separately before ordering. The total including VAT shown at checkout or in the individual quotation applies. Payment schedule, due dates, travel and additional costs are set out in the individual quotation. Where a project payment schedule is agreed, the 30% deposit and 70% balance are separate due amounts. Individually confirmed orders can be paid by bank transfer or a personal PayPal link; this link is not a new order and payment does not start the service automatically. Remote support booked directly through Cal.com covers 60 minutes for EUR 71.40 including 19% VAT and is paid through PayPal during booking. Additional time and services require separate agreement.

5. Configuration, testing and acceptance

Following configuration, the customer receives an introduction and an opportunity to test the functions. Where the quotation provides for a test period, identified deviations must be reported comprehensibly within that period. Statutory rights relating to defects remain unaffected.

6. Software and updates

The customer receives a non-exclusive, non-transferable right to use the supplied RKV software on the agreed system. Open-source components are subject to their respective licences. Corrections for the agreed service level and paid extensions are handled in accordance with the quotation.

7. Liability

RKV has unlimited liability for intent, gross negligence and injury to life, limb or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the damage typically foreseeable for the contract. Mandatory statutory liability remains unaffected. RKV is liable for failures or changes to third-party devices, networks and manufacturer services only where RKV is responsible for them.

8. Consumer rights

These terms do not restrict consumers' statutory warranty and cancellation rights. German law applies while preserving mandatory consumer-protection provisions.

9. Directly booked support and appointment cancellation

You can cancel or reschedule a directly booked remote support appointment free of charge up to 24 hours before it starts. For a later cancellation or no-show, RKV may claim compensation for the reserved slot up to the agreed price. Savings and an alternative booking are taken into account; you may show that no loss or a substantially smaller loss occurred. Your statutory right of withdrawal remains unaffected. A refund after an effective withdrawal is assessed under the statutory rules; cancelling an appointment does not replace a withdrawal declaration.

Ordering through the shop

Before ordering, the shop shows your selection, net subtotal, VAT, total and payment split. Clicking “Place order with obligation to pay” submits your binding offer for the selected services and items. The automatic acknowledgement confirms receipt; separate contract acceptance and the specific scope are confirmed personally. Any required technical review takes place before setup. Project work uses a 30% deposit and 70% after acceptance of the agreed work; remote support is payable separately in full. Payment does not automatically authorise equipment changes or installation. Additional services and costs require a separate agreement. Ordering alone does not request an early start before the cancellation period ends.

If you have paid for remote support in the shop, we arrange your appointment personally. Do not book the same support again through the paid appointment booking. Direct appointment booking is a separate order route.

Consumer information

Cancellation policy and model form

Right of cancellation

Consumers have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from conclusion of the contract; for a sales contract concerning goods, it generally begins upon receipt of the goods.

To exercise your right of cancellation, you must inform us – RKV Consultants and Engineers, Sunil-Rajender Vip, Schlüts Kamp 6, 32469 Petershagen, Germany, email: info@rkv-consultants.com – of your decision by an unequivocal statement. You may use the model form below, but this is not mandatory. Sending the notice before the deadline is sufficient.

Effects of cancellation

If you cancel, we will reimburse all payments received, including standard delivery costs, without undue delay and no later than fourteen days after receiving your cancellation. We generally use the same payment method for reimbursement. For goods, we may withhold reimbursement until we have received the goods or you have provided evidence of their return. You must return the goods within fourteen days and bear the direct return costs.

If you requested that a service begin during the cancellation period, you must pay an appropriate amount for the service supplied up to cancellation. The right to cancel a service expires on full performance only if you expressly agreed to early commencement and acknowledged that you would lose your cancellation right once the contract had been fully performed.

For directly booked remote support, you can use the electronic withdrawal function. It lets you review your details before submitting and promptly sends an email containing the declaration and the date and time it was received. You can also withdraw by email. The 24-hour appointment cancellation rule does not limit your statutory right of withdrawal.
